Homosexual Rights
So the California State Supreme Court has thrown out the voter ban on same sex marriage! Just because a majority of voters passed a law doesn't necessarily make it constitutional. That is why we have many layers of courts to begin with - to interpret laws passed by voters and Congress. We may not like the outcome but that is the court's job function under our Constitution. It seems that whenever we are angry at the Courts or vehemently disagree with their interpretation, whether from a Conservative or Liberal perspective, we call the Courts activists or making law behind the voters back. This is the beauty of our American system - it is truly unlike any other form of government on the scene today. Our system offers checks and balances and if any of the three branches get out of control the other two will pull it back to center, eventually. Dr. Robert Bowman, former Presidential candidate, Air Force Colonel and rocket scientist made the following observation on homosexual rights some years ago: "I support human rights; and the last time I checked, homosexuals were human beings. So by definition I support homosexual rights. They should have the same rights to life, liberty, and the pursuit of happiness as anyone else, and that includes the right to be free from discrimination and harrassment. From a moral and societal point of view, we should all oppose promiscuity, whether gay or straight. We tell our straight teenagers to 'Save it for marriage.' But what do we tell our gay teenagers to save it for? Now, many people are uptight about the word 'marriage.' They want it used exclusively for the union of a man and a woman. OK. So let's call a monogamous commitment between gays or lesbians 'pairage.' But for goodness sakes, we must encourage it, whatever it is called. We can no longer doom homosexuals to a lifetime of celibacy, closeted deceit, or promiscuity. We must hold out the hope of them being able to live in a lifelong relationship, and to have that relationship recognized by society and given all the legal rights, responsibilities, and privileges that accrue to married heterosexual couples."

Indy... Well said, I agree 100% I embrace all people and I hope no person who loves another will have to suffer from shame simply because they love someone of the same sex. I know as our more understanding youth grow older that we will have freedom and equal rights for all Americans and bigotry will fade as a distant memory. It can't happen soon enough for me. posted by

Indy.........I always thought the matter of homosexual rights (marriage) shouldn't have been on a ballot in the first place! If you walk upright and have opposable thumbs you are a HOMOSAPIEN and by all means have the right to marry any other HOMOSAPIEN you choose!!! Sparks, I too cannot wait for the day when racism and bigotry are a distant memory.

peacetoyou, I agree with you mostly that it is unfortunate that privacy issues show up on the ballot, especially like issues concerning a woman's right to choose. That clearly is the business between spouses and doctor. Domestic partnership, or pairage, is slightly different though. We had a case here in Portland, Oregon last year where two men had been living together as partners for 49 years when one fell to prostrate cancer. The hospital denied visitation by his partner because he wasn't family. It was a rather sad end to a sad story. Also, Oregon has documented 136 cases in the past three years of gay or lesbian citizens being fired from a job or turned down for rental housing JUST BECAUSE THEY ARE GAY. If gay people were legally recognized as a couple this would never be an issue. Legal recognition seems to be the only remedy in this situation. Hopefully one day in the future discussions like this won't be necessary.

There will be a day in history when we look back on the "gay bashing" days as we do with the "segregation of races."--in disbelief it happened in our lifetime.
