Doughnut case dismissed
Lack of evidence cited in sparing man third strike on theft charge. Robert Fassbender got lucky when his third strike case was dismissed due to lack of evidence. The Tehachapi man has a long history of run ins with the law. I sure hope that he See's the dropped chargers as a gift. This man should be thanking his lucky stars. Fassbender 51 years old probably would have died in prison if he was convicted on the third strike. This man is being given a second chance at life. I hope that he doesn't take it for granted. I also hope he learned his lessons from this case. However what I know of the case, I don't know if I could have found him guilty here, and no it isn't because of the three strike law. What to me seems in question is if the guy really did think his friend purchased the donut and if the clerk said anything to stop him. posted by

I believe that we all have the ability to tell ourselves"Hey-that's against the law-I think that I'll choose not to do that".What I'm questioning is if that's likely after a lifetime of choosing to break the law and try to get away with it.His extensive rap sheet was only regarding crimes where he got caught.It skips all of the ones he got away with.He also was aware of the three strikes law after his last strike.This is not news to him.Now that he has'beat the system",why would he not continue as he has done for years.No offense to your sons family by the way,Jewels,just kinda tired of crooks and their excuses.
