WHY WEREN'T THE LEGAL DUTIES OF OFFICE DISCHARGED CONCERNING MS. HOLLY HART?

The read is about as exciting as watching paint dry; but a necessary requirement if you're to know what can occur in your City and not occur. It's right there in the Municipal Code for you to read. This isn't rocket science.

Current City Officials "are banking" on your NEVER reading the Municipal Code that tells City Officials and Residents what they can do, and cannot do. However, you wonder why so many Officials appear out of control with their power? They are in fact out of control -- but are banking on YOU not knowing they're out of control -- so they take, and take, and take, and you can't stop them, because YOU won't read the very Municipal Code that governs them. They know the Code -- and know when YOU don't know. You wonder why they take great license with your lives and future? It not that great a leap to the conclusion. This isn't rocket science.

Think of it this way, if you read just two pages of the Municipal Code once a day, you'd know the overview of the entire Code in less than 30 days. THE TEHACHAPI MUNICIPAL CODE is the LAW in Tehachapi that ALL City Officials are suppose to follow. If they do not, they're in violation of the law. Knowing what is happening to you, and what's not suppose to be happening to you, is as close as your computer.

Based on the plain language of the Tehachapi Municipal Code, Ms. Holly Hart was in violation of the law when she attacked Councilman Beckman. The Presiding Officer of the Council meeting (Ed Grimes) knew it, or should have known it; Councilman Phil Smith knew it or should have known it; Councilwoman Vernon knew it or should have known it; and Councilwoman Deborah Hand knew it or should have known it.

Tehachapi Municipal Code, Title 2 ADMINISTRATION AND PERSONNEL. Chapter 2.08 CITY COUNCIL, states in pertinent part that:
"2.08.250 Decorum--Enforcement-Penalty for
Violation:

A. Sergeant-at-Arms. The chief of police or his representative shall be ex officio sergeant-at-arms of the council. He shall carry out all orders and instructions given him by the presiding officer for the purpose of maintaining order and decorum in the Council Chambers. PRESIDING OFFICER GRIMES KNEW OR SHOULD HAVE KNOWN TO DISCHARGE HIS DUTY AND DIRECT THE SERGEANT-AT-ARMS.

B. Any person in the audience who uses loud, boisterous or profane language at a council meeting, or language tending to bring the council, or any councilman, into contempt, or any person who persistently interrupts the proceedings of the council, or refuses to keep quiet or take a seat when ordered to do so by the presiding officer, shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine of not more than one hundred dollars, or by imprisonment in the city jail for a period of not more than thirty days, or by both such fine and imprisonment. Upon instructions of the presiding officer, it shall be the duty of any police officer present to eject any such person from the Council Chambers, or place him under arrest, or both. (Ord. 357 § 5(c), 1970) .
The plain language of the Tehachapi Municipal Code was operative at the time Ms. Hart attacked Councilman Beckman and brought contempt upon the Councilman and the Council. NOTHING -- NOTHING was done by anyone of the City Officials present at the City Council meeting last Monday. The result is a dereliction of duty, an out of control member of the Tehachapi Unified School District's Board; and a mockery of a meeting.

Each member of the Council was derelict in their duty according to the plain language of the Tehachapi Municipal Code. Council Members, don't kill the messenger. You're the wrongdoer -- not I. Moreover, I've read the Tehachapi Municipal Code, so don't even think of even attempting to intimidate me. I'm educated and "lettered".

That dereliction of duty ACCORDING TO THE TEHACHAPI MUNICIPAL CODE -- speaks VOLUMES.

If there was such blatant dereliction of duty IN PLAIN VIEW OF THE PUBLIC, what dereliction of duty is occurring BEHIND CLOSED DOORS? This isn't rocket science.

If you heard about this spectacle; and it doesn't cause you to think about such out of control Public Officials, who care nothing about the decorum of office, then what makes you think that they care a nickel's worth of dog meat about YOU? Councilwoman Hand is fighting for her political life, as well as Phil Smith, as well as Ed Grimes, as well as Linda Vernon who should come to terms with the fact that they bring disrepute upon their offices; and we won't even talk about the seedy underworld of City Manager Jason Caudle.
Again, this isn't rocket science. Each and every City Official on the Council who remained in abject silence brought disrepute to their office as well as neighboring Cities who surely must have heard about the debacle of a council meeting and printed the results accordingly.

The once proud City of Tehachapi is made to look like the laughing stock of every other City. TEHACHAPI is made to look like bumbling small thinkers; because we're the ones who put these people in office -- or worst yet, kept them in office.

What do you expect with the current officials in office? They're the same ones who recently blew Three Million Dollars on a fire station less than a mile away from the existing one -- all because they didn't read the building code.

I hope you're sick and tired -- of being sick and tired -- of being made to look like fools -- manipulated and controlled by persons who couldn't put a college degree together if their lives depended upon it; and they run your Government.

Maybe it was thought that those without degrees would be more easy "to check". Well if the Tehachapi Municipal Code isn't read and there are no "checks and balances", then they are the most frightening persons to be in control. Hence, Tehachapi finds itself -- governed by the "unlettered" and ungovernable that appear to be completely out of control -- and with impunity. That's blind power and the worst kind that we find ourselves embroiled in. If you're not concerned about the current administration, then you're not using your vision and your reading abilities -- with all due respect.
