Even if there was no intent to kill anybody (But yer honor, I just slap people around with my loaded firearm!), the fact that their struggle resulted in the gunshot, and then they only made a delayed and half-hearted attempt to get her medical treatment - instead of calling 911 right away - should count for some kind of charge against the others who admitted being involved!   I could see if Logan made a plea deal (I'm not advocating, but I can see why they'd offer one), but he didn't even ID Rosenberg.!And yet  he concedes they struggled and the gun went off.
